JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-08-2017 Considering the fact that the petitioner has filed this case for quashing of the FIR of Aurangabad Town P.S. Case No. 40 of 2014 dated 24.01.2014.

Since more than three years has elapsed there is no point to interfere into the merit of the case. The court has reason to believe that investigation is complete and after investigation certain steps must have been taken during the interregnum, hence the court in the absence of material about present status of the case, cannot pass positive order in the instant case. In the circumstances, ends of justice be served, if the petitioner files appropriate application at appropriate stage along with order of this, the court below will pass a reasoned and speaking order within a further period of two months from the date of filing of such application and dispose of the same in accordance with law.
