2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 504, 379, 354, 509 of the Indian Penal Code.
3. As per the prosecution, a case has been lodged against the petitioner, in which informant has alleged that his wife was returning to home then the petitioner made comment on her and upon oppose he abused her. Informant has alleged that when she reached to meet the petitioner then he stated abusing her and caused injury on the lips of the informant and snatched Rs.5,000/- form her.
4. It is submitted by learned counsel for the petitioner that petitioners is innocent and has committed no offence. Counsel for the petitioner submits that both the informant and petitioner are residents of the same village and over petty matter the dispute
Patna High Court CR. MISC. No. 58823 of 2023(2) dt.13-09-2023 2/2 occurred. Counsel submits that on the said date a fight took place between both the sides and due to this both the sides were injured. Counsel also submits that from the same date and from the same place of occurrence, case and counter-case were filed bearing Maintained P. S. Case No.25 of 2019 and Maintained P. S. Case No.26 of 2019 from the informant's side and petitioner's side respectively.
5. Learned APP for the State opposes the prayer for bail but submits that from the pleading it transpires that from the same date and from the same place of occurrence, case and counter case have been filed.
6. In the present facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Maintained P. S. Case No.25 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
