JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners are accused in connection with Bounsi P.S. Case No. 53 of 2015, registered under Section 304(B), 201/34 of the Indian Penal Code.
The accusation is of killing of daughter of the informant by her husband and other in-laws due to nonfulfillment of demand of dowry and throwing the dead body in the well.
Learned counsel for the petitioner submits that, in fact, deceased had gone to attend call of nature and fell down in the well and she was removed from the well, but due to misunderstanding, the informant lodged the present case making
Patna High Court Cr.Misc. No.19685 of 2016 (2) dt.11-05-2016 2/2 false allegation of demand of dowry and throwing the dead body in the well. Further submission is that petitioners are father-inlaw and mother-in-law of the deceased and they are in custody since 31.01.2016. Further submission is that similarly situated co-accused, Pramod Mohli has already been granted privilege of bail by this Court vide order dated 15.02.2016 passed in Criminal Misc. No. 46902 of 2015.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-II, Banka in connection with Bounsi P.S. Case No. 53 of 2015.
