Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and three other persons are named in the first information report whereas 3 to 4 unknown persons have also been made accused in the present case. The allegation against the petitioner is that he along with others assaulted the informant and others, as a result whereof one Suresh Yadav sustained head injury and in course of treatment, he died. The post mortem report of the deceased Suresh Yadav goes to show that two injuries were found on his person. The fardbeyan of the informant reflects that it were

Patna High Court Cr.Misc. No.20192 of 2016 (2) dt.13-05-2016 2/2 co-accused Devnarayan Yadav and Suresh Gope, who assaulted the deceased with iron rod causing injury on his head. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Hilsa ( Nalanda) in connection with Session trial no. 92 of 2016 arising out of Chandi P.S.Case No. 317 of 2015.
