2. Petitioner apprehends his arrest in connection with Ara Nagar P.S. Case No. 62 of 2023, registered for the offence punishable u/s 20, 21(c) of the NDPS Act.
3. Allegedly, 293 grams Heroine has been recovered from the house of the co-accused Raju Pawan, who is brother of this petitioner.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on concocted facts. He is not named in the FIR. No
Patna High Court CR. MISC. No.55847 of 2023(2) dt.31-08-2023 2/2 incriminating article has been recovered from the conscious physical possession of the petitioner rather 293 gram Heroine is said to have been recovered from the house of co-accused Raju Paswan. He has been made accused in the present case merely because he is brother of co-accused Raju Paswan. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of case as well as nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected. (Anjani Kumar Sharan, J) divyanshi/- U T
