1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118, 109, 352, 351(1), 74 and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against petitioner no. 2 and petitioner no. 1 is alleged to have assaulted the husband of the informant by lathi causing injury on his shoulder and finger. Further, Sanjit Kumar is alleged to have assaulted the son of the
Patna High Court CR. MISC. No.53626 of 2025(2) dt.20-08-2025 2/3 informant with lathi on his head and chest causing injury.
4. Learned counsel for the petitioners submits that injury suffered by the injured who are alleged to have been assaulted by the petitioners has been opined to be simple in nature, though injury suffered by the son of the informant who is alleged to have been assaulted by Sanjit Kumar has been opined to be grievous. It is further submitted that from the side of the petitioners also Hajipur Town P.S. Case No. 355 of 2025 has been instituted against the informant and his side.

Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioners but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that petitioners are not the criminals and the injury suffered by the injured who are alleged to have been assaulted by them has been opined to be simple in nature.

Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.53626 of 2025(2) dt.20-08-2025 3/3 amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Hajipur Town P.S. Case No. 356 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
