The petitioner apprehends his arrest in a criminal prosecution registered under Sections 399, 402 and 414 of the Indian Penal Code as also under Sections 25 (1-B)(a)/26/35 of the Arms Act.
Taking into consideration the fact that the petitioner is specifically named in the first Information Report vide Annexure1 as an accused and also taking into consideration the fact that the fire arms and other incriminating articles were seized by the police from the place of the occurrence, from where the petitioner succeeded in fleeing away, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Manjhagarh P.S.Case 19 of 2016 pending in the court of the learned Chief Judicial Magistrate, Gopalganj is rejected.
However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered on its own merits
