JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 379, 511/34 of the Indian Penal Code.

Petitioner is said to have been caught red handed while he was trying to remove cash from the bag of a customer and for the aforesaid act, petitioner is in jail custody since 04.02.2016.

Submission on behalf of the petitioner is that petitioner was caught on mere suspicion and as a matter of fact, nothing had been recovered from his conscious possession. Moreover, petitioner does not have any criminal antecedent.

No.20558 of 2016 (2) dt.19-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 66 of 2016.
