JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 413/414 of the Indian Penal Code.
Though the petitioner is not named in the F.I.R. During investigation stolen motorcycle was allegedly recovered from the possession of the petitioner.
Submission is that petitioner has got no criminal antecedent and he is in custody since 10.03.2017. Considering the nature of allegation and the period already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-
Patna High Court Cr.Misc. No.30299 of 2017 (2) dt.11-07-2017 2/2 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/Successor Court, in connection with Shahpur P.S. Case No.214 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
