2. The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 216 of 2022, registered for the offence punishable under Sections 20(b)(ii)(c), 23(c), 27(b), 29 of the Narcotic Drugs and Psychotropic Substance (NDPS) Act.

3. As per prosecution, the petitioner was found running from the house of one Mishri Rai in which 32 kgs. 700 grams ganja was recovered. The petitioner was not caught at the spot, having clean antecedent and he is in jail since 02.07.2023.

4. Learned APP has vehemently opposed the prayer for bail.

5. Considering the aforesaid fact, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, in connection with Bidupur P.S. Case No. 216 of 2022.

7. This is also subject to the condition that the petitioner shall mark his presence in Bidupur Police Station, District- Vaishali at Hajipur on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
