Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 303(2) and 317(2) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that 100 cft. sand was found loaded on a tailor and the same was seized as it was parked near Railways over-bridge. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner was carrying sand on valid challan issued for 26-4-2025 from 5:41:15 pm to 8:41:15 am. It is further submitted since the tailor had a flat tyre,

It is next submitted that had the petitioner been indulging in carrying illegal sand, in that event he would not have left the tailor parked near a Railways over-bridge. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that the petitioner is a person with clean antecedents and had a valid challan for carrying sand, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kadirganj P.S. Case No. 127 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
