JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-414/34 of the Indian Penal Code and under Sections25(i-B)A/26/35 of the Arms Act. The petitioner and one Kashi Kumar @ Rajpal Yadav were arrested and one loaded country-made pistol and two live cartridges are said to have been recovered from possession of the petitioner. So far as recovery of motorcycle is concerned; according to prosecution case itself, the aforesaid motorcycle was recovered from joint possession of petitioner and other accused. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Daudnagar P.S. Case No. 260 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar.
