The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 365/34 of the Indian Penal Code and later on added Section 302 of Indian Penal Code.
The prosecution case in nutshell is that petitioner along with other co-accused persons abducted the younger son of informant and informant has strong suspicion against the petitioner and other co-accused
Patna High Court CR. MISC. No.54835 of 2022(2) dt.17-01-2023 2/3 persons that they have killed his younger son. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial custody since 11.05.2022. It is further submitted that there is no eye witness of the alleged occurrence. It is also submitted that son of petitioner ie. deceased was a drug addict and petitioner has no concern with any type of addiction. Both parties are co-villager & petitioner happens to be the friend of the deceased. On the perusal of Postmortem Report, Doctor has kept his opinion reserved and viscera is preserved. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, similarly situated coaccused person has been granted Bail vide order dated 04.01.2023 passed in Cr. Misc. No. 40861 of 2022 by this Court.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Hussainganj P.S. Case No. 46 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IXth, Siwan.
