JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-02-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for offences punishable under sections 465, 467, 468, and 471 of the Indian Penal Code.

The allegation against the petitioners is that they were constructing house on the land of the complainant on the basis of forged signature purported to be executed by the father of the complainant.

It is submitted that it is out and out a case of civil nature as on the basis of the agreement to sell, the petitioners were put in possession of the land. He has further submitted that a co-

Patna High Court Cr.Misc. No.32599 of 2014 (3) dt.02-02-2015 2/2 accused has already been granted bail by the learned Court below. The petitioners have no criminal antecedents. Considering the facts and circumstances, in case of arrest or surrender within a period four weeks, the above named petitioners shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Shri T.A. Kumar, learned Judicial Magistrate, Birpur in connection with Complaint Case No. 285C of 2013, subject to condition as laid down under Section 438( 2) of Cr. P.C.
