JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

Two country made loaded pistols and two live cartridges are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 28.11.2015. Petitioner carries criminal antecedent of four cases but submission on behalf of the petitioner is that petitioner has already been acquitted in Barbigha P.S. Case No. 145 of 2014 whereas he has been released on bail in Asthawan P.S. Case No. 133 of 2015 as well as Asthawan P.S. Case No. 150 of 2013.

Patna High Court Cr.Misc. No.19920 of 2016 (2) dt.06-05-2016 2/2 Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 94 of 2015.
