02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 414 and 120B of the Indian Penal Code and Sections 47A and 54/57 of the Prohibition of Bihar Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 124.92 litres of foreign liquor were recovered from the vehicle which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 24.08.2016. Having regard to the facts and the circumstances of

No.31809 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 143 of 2016 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to U.P. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
