The petitioner seeks pre-arrest bail in connection with Hasspura P.S. Case No. 83 of 2018 registered under Sections 304B read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that from the first information report itself, it would appear that the petitioner happens to be uncle-in-law of the victim. He is living separately from the family of the in-laws of the victim since long and has no concern with their day-to-day affairs.
Patna High Court Cr.Misc. No.35325 of 2018 (2) dt.28-06-2018 On the other hand, learned counsel for the informant submitted that the daughter of the informant was killed in her matrimonial home and the petitioner being uncle-in-law has also been named as one of the accused in the first information report. Regard being had to the fact that the petitioner is a distant relative and his name is given with omnibus allegation, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 83 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
