Petitioner has filed this modification application for modification of order dated 19.06.2019 passed in Criminal Miscellaneous No. 12662 of 2019 whereby allowing the anticipatory bail petition, the petitioner was directed to surrender before the learned court within four weeks and furnish bail bond.

Petitioner has sought extension of time for surrender before the learned lower court submitting that as the DistrictKishanganj of which the petitioner is resident is flood

Patna High Court CR. MISC. No.53792 of 2019(2) dt.04-09-2019 2/2 affected area and remained deluged in the flood for around one month, hence, he could not surrender before the learned lower court in compliance of the order of this Court within stipulated period.

Having regard to the facts and circumstances of the case, petitioner is directed to surrender before the learned lower Court and furnish bail bond within two weeks from the communication of this order.

Accordingly, the order dated 19.06.2019 passed in Criminal Miscellaneous No. 12662 of 2019 is modified to the extent as indicated above and this application is disposed of. (Prakash Chandra Jaiswal, J) rohit/- U T
