JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 03.01.2016 in connection with Gopalganj Town P.S. Case No. 519 of 2015, corresponding to G.R. No. 3993 of 2015 for the offences instituted under Sections 394 of the IPC and 27 of the Arms Act. The accusation is of snatching the money after causing fire arm injury upon the informant while he was going to Gopalganj from his Horlics Agency, Sasamusa, alongwith a staff of the said company.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.01.2016 and the charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.21244 of 2016 (3) dt.22-07-2016 2/2 tampering with the evidence against the petitioner. The petitioner is not named in the F.I.R. He has been made accused in the present case on the basis of a confessional statement of co-accused. He has not been put on T.I. Parade to ascertain his implication in the present case. There is no recovery of any incriminating article from his possession. The other co-accused has been granted bail by this Court vide Cr. Misc. No. 13646 of 2016. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Gopalganj Town P.S.
