The petitioner is languishing in custody in connection with Birpur P.S. Case No. 16 of 2013 for the offences instituted under Sections 364, 302/34 of the Indian Penal Code. The prosecution story in brief, is that on 08.03.2013 the informant's son namely Abdul Bahaw had gone to Begusarai at motorcycle along with the petitioner, but the victim did not return and on query, no proper reply was given. Thereafter, on 10.03.2013 on the basis of Newspaper, informant found the dead body of his son in the Bakhari Police Station. Patna High Court Cr.Misc. No.21605 of 2016 (6) dt.02-08-2016 2/2 submitted in the present case. There is no criminal antecedent against the petitioner. There is no allegation of tampering of the witnesses against the petitioner. Petitioner is not named in the F.I.R. The only material is confessional statement of Jagannath Chourasiya. The other co-accused Kanhaiya Paswan and Gagannath Chourasiya have already granted bail vide Cr. Misc. No. 3479 of 2013 and Cr. Misc. No. 35987 of 2013. On behalf of the State it has been submitted that the petitioner is made accused in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai, in connection with Birpur P.S. Case No. 16 of 2013 (G.R. Case No. 788 of 2013).
