JUSTICE RAKESH KUMAR ORAL ORDER 03-07-2018 Heard Sri Ashok Kumar Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Sasaram (M) P.S. Case No. 503 of 2016 registered for offence under Sections 47(a) , 153(a), 53(b), 54 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of anticipatory bail.

At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph -3 of the petition to show that petititioner is having clean antecedent. He further submits that in this case, the petitioner has been made accused only on the ground that petitioner's motorcycle was found lying outside a hotel and from the hotel, huge quantity of Indian Make Foreign liquor as well as about 1⁄2 litres of Indian

Patna High Court Cr.Misc. No.33624 of 2018(4) dt.03-07-2018 2/2 Make Foreign liquor was shown to be recovered from an Alto Car, which was standing outside the hotel. He further submits that nothing was recovered either from the conscious possession or from motorcycle of the petitioner.

Be that as it may, considering the nature of accusation, non-recovery from the petitioner as well as clean antecedent of the petitioner, in the event of his arrest or surrender within six weeks from today, let the petitioner, namely, Manoj Kumar Singh, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge(Excise), Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 503 of 2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
