JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 302 and 201/34 of the Indian Penal Code. Petitioner no.1 happens to be father-in-law whereas petitioner no.2 is married Nanad of the deceased. The marriage of the deceased had taken place eight years ago and she gave birth to a daughter out of the aforesaid wedlock. The informant claims that the dead body of the deceased kept in a sack was recovered from a Canal.

Submission on behalf of the petitioners is that the mother-in-law as well as husband of petitioner no.2 have already been granted privilege of bail by a Co-ordinate Bench of this

Patna High Court Cr.Misc. No.20450 of 2016 (2) dt.13-05-2016 2/2 Court whereas petitioners are in jail custody since 1.3.2016. It is further submitted that the charge sheet has already been submitted and moreover, except suspicion, there is no any other material against the petitioners. It is further submitted that the husband of the deceased has already been remanded in this case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Bhojpur, Ara in connection with Ayar P.S. Case No.61 of 2015.
