JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-05-2023 The limited prayer of the petitioner, in the present writ petition is to direct the Circle Officer, Ramgarhwa, District-East Champaran, Motihari i.e. respondent no.5 to dispose off the pending Encroachment Case No.05 of 2020-21.

The learned counsel for the respondentState submits that in case the aforesaid encroachment case is still pending, the same shall be taken to its logical conclusion, within a stipulated time frame, as fixed by this Court. Having regard to the facts and circumstances of this case, I deem it fit and proper to direct the respondent no.5 to dispose off the aforesaid Encroachment Case No.05 of 2020-21, in case the same has not already been disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in

Patna High Court CWJC No.14916 of 2022(2) dt.10-05-2023 3/3 accordance with law and after hearing the affected parties, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
