====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under sections 363 and 366 of Indian Penal Code.

Allegedly, the younger brother of the petitioner alongwith other accused named in the F.I.R. are said to have kidnapped the daughter of the informant.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case and there is general and omnibus allegation against the petitioner. Petitioner has no criminal antecedent. It is further submitted that similarly situated co-accused has been granted anticipatory bail by this Court vide Order dated 26.05.2022 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.58099 of 2022(2) dt.21-12-2022 2/2 49281/2021.

Learned APP for the State vehemently opposed the prayer for anticipatory bail.

Considering the fact that similarly situated co-accused has been granted anticipatory bail, as let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Ram Krishna Nagar P.S. Case No. 30 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
