JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in N.T.P.C. P.S.Case No.10 of 2017 for the offences under Sections 25[1-b] a, 26 and 35 of the Arms Act.

The case of the prosecution is that the informant had received an information that certain people were planning to take away copper wire from the place where the wall was said to have been broken. On receipt of the information police arrived at the place of occurrence and saw 6-7 people running away, but on chase two persons were caught, namely, Pappu Kumar and Sonu Kumar. The said two accused persons are said to have named the petitioner as the person who had fled away from the scene.

Patna High Court Cr.Misc. No.30431 of 2017 (2) dt.06-07-2017 2/2 Learned counsel for the petitioner submits that the petitioner has not been apprehended at the spot, name of the petitioner has surfaced in this case merely on the basis of confessional statement of the main accused persons, similarly situated persons have been granted anticipatory bail by this Court vide order dated 10.05.2017 passed in Cr.Misc.No.14061 of 2017, the petitioner has clean antecedent and he is in custody since 26.02.2017.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri A.K.Thakur, Sub Judge-2nd - cum- A.C.J.M., Barh, Patna, in N.T.P.C.(Barh) P.S. Case No.10 of 2017.
