====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 22(b) of the N.D.P.S. Act and 18(a)(i), 18(c), 27(a) and 27(b)(ii) of Drugs and Cosmetic Act. The prosecution case in short is that cough syrup containing codeine and several other medicines have been recovered in this case.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that cough syrup containing codeine along with other medicines have been

Patna High Court CR. MISC. No.50926 of 2019(2) dt.16-08-2019 2/2 recovered for which proper document has not been produced. The petitioner is a licensee of retail drug. There is no compliance of Section 100 of the Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/ Special Judge, East Champaran at Motihari in connection with N.D.P.S. case No. 52/19 arising out of Raxaul P.S. Case No. 244/19.
