JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-10-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366A, 34 of the Indian Penal Code. The informant alleges that on 15.08.2018, his minor daughter was kidnapped by the accused persons including the petitioner in a vehicle from the school gate. Patna High Court CR. MISC. No.55708 of 2023(3) dt.17-10-2023 2/3 been implicated in this case. There is general and omnibus allegation against the petitioner. The victim was recovered and her statement was recorded under Section 164 Cr.P.C in which, she has not named the petitioner. She has not alleged any wrong doing against the accused persons. The petitioner is languishing in custody since 15.07.2021. Moreover, other similarly situated coaccused has been granted bail by a coordinate Bench of this Court vide order dated 24.05.2022 passed in Cr. Misc. No. 1939 of 2022.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Darbhanga in connection with Kamtaul P.S.
