2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 414 and 34 of the Indian Penal Code and Sections 8, 8(c), 20(b)II(A), 21(a), 29 and 22 of the NDPS Act.
3 . As per the prosecution case , 9.45 grams smack like intoxicating substance was recovered from the possession of co-accused Sah Intezar Alam who was apprehended on the spot.
4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case only on the basis of suspicion . No smack like intoxicating substance has been recovered from the conscious possession of
Patna High Court CR. MISC. No.53992 of 2025(3) dt.19-09-2025 2/2 petitioner and has got no concern with the alleged occurrence . Charge sheet has already been submitted. Petitioner is in custody since 10.07.2025 . Petitioner has got 1 criminal antecedent of different nature in which he is on bail. 5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Spl. Judge (NDPS Act), Kishanganj in connection with Kochadhaman P. S. Case No. 173 of 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
