The petitioner seeks bail in Maniyari P.S. Case No 09 of 2017 under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Sections 25(1-b)A, 26(ii), 35 of the Arms Act and Sections 20, 22 of N.P.S. Act.

Acting on a tip off, police party conducted a raid and three miscreants were apprehended who disclosed their names as Vikash Kumar @ Mahantha, Sandip Kumar Jha and Udit Jha @ Sona Babu and from possession of the petitioner one loaded country made pistol, four live cartridges, three strips Ativan tablets and three mobile phones were recovered.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has been falsely

Patna High Court Cr.Misc. No.28112 of 2017 (2) dt.03-07-2017 2/2 implicated in this case. Petitioner is in jail since 14.01.2017. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Maniyari P.S. Case No. 09 of 2017.
