SONI SHRIVASTAVA ORAL ORDER 15-04-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the complainant.
2. Petitioner apprehends his arrest in connection with Complaint Case No. 769C of 2022 registered for the offences punishable under Sections 498A of the Indian Penal Code and section 4 of the D.P. Act.
3. By an earlier order dated 11.09.2024, considering the fact that the dispute relates to the matrimonial discord between the husband and the wife, the matter was sent to the Mediation & Reconciliation Center for amicable settlement of the dispute.
4. In the first round of mediation, it appears that the process of mediation had failed and thereafter, the matter was
Patna High Court CR. MISC. No.58689 of 2024(4) dt.15-04-2025 2/3 once again referred to the Mediation Center on 18.01.2025. The report of the Patna High Court, Mediation Centre is available on the record at Flag-N which would go to show that the matter has been resolved and the parties have agreed to stay together as husband and wife and other terms have also been agreed upon vide agreement dated 28.03.2025.
5. Learned counsel for the complainant is also appearing and he supports the fact that both husband and wife are staying together and no dispute remains between the parties.
6. Considering that the matter has been resolved by the Patna High Court Mediation Center and also considering the fact that the parties are now residing together, the petitioner is directed to be enlarged on anticipatory bail. Accordingly, in the event of his arrest/ surrender within a period of four weeks from today the petitioner shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Hilsa, Nalanda in Complaint Case No. 769 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
7. However, it is also made clear that in case of any violation of the terms of the agreement, the learned counsel for
Patna High Court CR. MISC. No.58689 of 2024(4) dt.15-04-2025 3/3 the complainant would have liberty to pray for cancellation of bail bond of the petitioner.
