The petitioner seeks pre-arrest bail in connection with Katihar Towan P.S. Case No. 55 of 2018 registered for the offences under Sections 379, 406, 409, 120-B/34 of I.P.C and under Section 7 of the Essential Commodities Act, 1958. Learned counsel appearing on behalf of the petitioner submits that, the petitioner was posted at Data Operator at the time of alleged occurrence. He had no concern about the dealing with the food grains. Further submission is that co-accused Mithilesh Kumar Yadav @ Pushkar Yadav, Sunil Kumar @ Sunil Kumar Panjiyar have already been granted anticipatory bail by different
Patna High Court Cr.Misc. No.31373 of 2018 (2) dt.12-06-2018 2/2 coordinate Benches of this Court vide orders dated 18.05.2018 and 17.05.2018 passed in Criminal Misc. No.29893 of 2018 and Criminal Misc. No.30559 of 2018, respectively. Petitioner has got no criminal antecedent.
Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of arrest or surrender before the learned Court below within six weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in Katihar Town P.S. Case No.55 of 2018 subject to the condition as laid down under Section 438(2) Cr.P.C.
