Petitioner apprehends his arrest in connection with Nagarnausa P.S. Case No. 33 of 2018, registered for the offences punishable under Sections 341, 323, 307, 353, 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the allegation is general and omnibus in nature and no specific allegation of assault has been attributed against the petitioner. In fact, the petitioner happens to be an old handicapped lady by her eyes, which is evident from annexure-2, and she has not
Patna High Court Cr.Misc. No.32076 of 2018 (3) dt.06-06-2018 2/2 committed any theft of electricity. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner above named, in the event of his/her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Hilsa, Nalanda in connection with Nagarnausa P.S. Case No. 33 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
