Petitioner is languishing in custody since 15.02.2017 in connection with Saharsa (Sadar) P.S. Case No. 130/17 for offences punishable under Sections 25(1-b) A/26 of the Arms Act. The prosecution case, as lodged by the police personal, is that while he was on checking duty, as the place of occurrence was a disputed one, he found the petitioner possessing one country-made pistol loaded with one live cartridge and also seven other live cartridges.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and that
Patna High Court Cr.Misc. No.31408 of 2017 (2) dt.12-07-2017 2/2 charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail.
Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa (Sadar) P.S.
