In this case, the petitioner is seeking bail in connection with Ander P.S. Case No. 34 of 2015 registered for offences under sections 406, 408, 420 and 379 of the Indian Penal Code.

Allegation has been made that fraudulently the money was withdrawn by the petitioner.

The counsel for the petitioner submits that after 35 days of the alleged incident, a complaint was filed. The matter was sent to the Police under section 156(3) of the Criminal Procedure Code and the same was registered as a criminal case. As there is a delay of 35 days, looking to the facts

Patna High Court Cr.Misc. No.21430 of 2016 (2) dt.20-05-2016 2/2 and circumstances of the case, the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Ander P.S. Case No. 34 of 2015, subject to the condition that if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail.
