JUSTICE RAKESH KUMAR ORAL ORDER 13-06-2018 Heard Sri Pramod Kumar Singh, learned counsel, assisted by Sri Awadhesh Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Khanpur P.S. Case No.4 of 2018 registered for the offence under Sections 47, 30(a), 38(1)(2)/41(1)(2) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of arrest or surrender.
At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. It has also been argued that save and except the fact that petitioner's name has come in confessional statement of
Patna High Court Cr.Misc. No.32582 of 2018(2) dt.13-06-2018 2/2 co-accused, there is no other material to connect the petitioner. He submits that nothing was recovered from the conscious possession of the petitioner.
Considering the nature of accusation as well as the fact that the petitioner's name has come in confessional statement , let the petitioner, namely, Surendra Ram @ Shender Ram @ Sohendra Ram @ Suhinder Ram @ Sohindra Ram, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Addl. Sessions Judge, Samastipur in connection with Khanpur P.S. Case No.4 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
