In this case, the petitioner is seeking bail in connection with Pocso Case No. 26/2015 arising from Supaul Mahila P.S. Case No. 77 of 2015 registered for offences under sections 366A/376/34 of the Indian Penal Code. The victim is a student of Sanskrit School, has established a telephonic talk with one Sanjay and at his instance, she along with her friend, namely, Puja Kumari had gone to Laxman Chowk there the victim and others have taken break fast as well as betel and thereafter, she had gone along with Sanjay. There is an allegation against Sanjay that he had given the assurance for marriage and established physical relationship with the victim.
The counsel for the petitioner submits that there is no
Patna High Court Cr.Misc. No.21254 of 2016 (2) dt.19-05-2016 2/2 direct allegation against the petitioner and the victim herself had gone with Sanjay and this first information report has been lodged by the victim herself.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st A.D.J., Supaul in connection with Pocso Case No. 26/2015 arising from Supaul Mahila P.S. Case No. 77 of 2015.
