2. The petitioner is in custody since 31.01.2016 in connection with Semra P.S. Case No. 5 of 1998 for the offences alleged under Sections 364(A), 120(B), 395 and 397 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated only on the confessional statement of coaccused Bala Chaudhary. It is stated that the petitioner has been living at Punjab working as labour in a factory and was not aware of the present case having been instituted with his involvement in it. It is stated that almost all similarly situated accused persons have been granted bail.

4. Having regard to the entirety of the facts and

No.21893 of 2016 (2) dt.19-05-2016 circumstances of the case, let the petitioner Ramadhar Chaudhary be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Bagaha, Dist- West Champaran in Sessions Trial No. 119(A) of 1999 arising out of Semra P.S. Case No. 05 of 1998.
