In this case, the petitioners are seeking anticipatory bail in connection with Kashichak P.S. Case No.82 of 2019, registered for the offence punishable under Section 341, 323, 324, 307, 435, 504, 506/34 of the Indian Penal Code. Allegation against the co-accused including the
Patna High Court CR. MISC. No.50966 of 2019(2) dt.17-08-2019 2/3 petitioners is to have assaulted the informant with different deadly weapons causing injuries to him, however, counsel for the petitioners submits that in the order of learned Sessions Judge, it has been mentioned that the injury report has been prepared on 25.05.2019 at 7.40 P.M., whereas, the incident has taken place on 26.05.2019, as such, the same was prepared one day before the incident.
In such view of the matter, let the petitioners, above-named, be released on provisional anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Kashichak P.S. Case No. 82 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
The Court below is directed to call for the original injury report and if it is found that the injury report has been prepared on 25.25.05.2019 at 7.40 P.M. then their provisional bail will be confirmed and in the event that the injury report shows otherwise, their bail bond will be treated to have been
