JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
It is alleged that the informant's daughter returned to her house on 20.6.2013 and disclosed that on 30.5.2013 at about 11 P.M. when she went outside to answer the call of nature, accused persons took her to Bombay for marriage purposes and kept in confinement.
It is submitted by learned counsel for the petitioner that the victim is married lady. FIR was lodged with inordinate delay. It is further submitted that
Patna High Court Cr.Misc. No.33597 of 2014 (2) dt.13-02-2015 2/2 the conduct of the victim reflects that she went to Mumbai of her own and the husband of the victim has not filed any case. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Matihani (Begusarai) P.S. Case No. 58 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
