Petitioner seeks regular bail in connection with Ladaniya P.S. Case No.43 of 2017 (G.R. No.483 of 2017) registered for the alleged offences under Sections 272, 273 and 30 (a) of the Bihar Prohibition and Excise Act.
As per the prosecution case, 24 liters of Nepali wine is said to have been recovered from the shop of the petitioner and the petitioner was apprehended.
It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. Due to village politics, petitioner has been falsely implicated in this case. There is no recovery from the conscious physical possession of the petitioner. He has been languishing in
Patna High Court Cr.Misc. No.28938 of 2017 (02) dt.03-07-2017 2/2 jail custody since 21.04.2017.
In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M.-IVth, Madhubani in connection with Ladaniya P.S.
