JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Chapra Muffasil P.S. Case No. 345 of 2015, registered under Sections 402, 489, 468, 467, 399, 471, 472 and 420 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. The accusation is that the mobile number of the petitioner was on prelisting at the mobile of the informant Officer-in-Charge of Sahajitpur P.S. in that course it has come in the knowledge of the informant that the petitioner along with others are making plan to commit heinous crime and accordingly the house of Yogendra Yadav was raided where five persons including the petitioner were apprehended. On search, the petitioner was found in possession of one country made pistol

Learned counsel for the petitioner submits that petitioner having no criminal antecedent is in custody since 01.01.2016. The petitioner has been implicated in this case mere on suspicion.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 345 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
