Mr.Shantanu Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-09-2019 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Salimpur PS case no. 212 of 2018 instituted for the offences punishable under Sections 307 and other sections of Indian Penal Code and Section 27 of Arms Act. The allegation is regarding the accused persons having arrived at the house of the informant and thereafter, engaged in assault and firing by firearms on the informant resulting in injury to the informant.

The learned counsel for the petitioners submits that the petitioners are innocent and have been falsely

Patna High Court CR. MISC. No.51911 of 2019(3) dt.27-09-2019 2/2 implicating in the present case and moreover, no allegation regarding any overt act has been levelled qua the petitioners herein. Lastly, it is submitted that co-accused Arwind Singh has been granted bail by a coordinate Bench of this Court vide order dated 25.02.2019 passed in Cr. Misc. no. 79783 of 2018. The petitioners are languishing in custody since 29.06.2019 and are stated to be having clean antecedent.

Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. III, Barh, Patna in connection with Salimpur PS case no. 212 of 2018.
