Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case in confessional statement of co-accused Vijay Manjhi and it is evident from perusal of the impugned order of the learned court below that the learned court below has referred some paragraphs of the case diary to show the involvement of the petitioner in this case but, simultaneously, the learned court below has mentioned in the impugned order that in the aforesaid paragraphs, the witnesses have only supported the prosecution story.

No.20623 of 2016 (2) dt.19-05-2016 2/2 accused Vijay Manjhi, there was love affair of his daughter-in-law with a person and being annoyed with the aforesaid love affair, he committed murder of his daughter-in-law and after that with help of petitioner made attempt to destroy the dead body of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 04.01.2016, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Danapur in connection with Dulhin Bazar P.S.Case No. 116 of 2015.
