The petitioners seek bail in a case registered under Sections 341, 323, 324, 325, 307, 326(A), 504, 354, 427/34 of the Indian Penal Code.
The prosecution case in short is that in the backdrop of land dispute, the accused persons poured acid on the informant, as a result of which, he sustained burn injuries. It is also alleged that one of the accused cut the finger of one Sanjay Mahto. It has been submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.55865 of 2019(2) dt.03-09-2019 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 02-06-2019. Charge sheet has already been submitted. The nature of injuries sustained by two of the victims is said to be simple. So far the injury sustained by third victim is concerned, the same is on non-vital part of the body. No offence u/S 307 of the Indian Penal Code is made out.
On behalf of the State and O.P. No. 2 , it is submitted that the petitioners are named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Saran at Chapra in connection with Isuapur P.S. Case No. 101 of 2019.
