JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302, 201, 120-B/34 of the Indian Penal Code and Section 27 of the arms Act.
The name of the petitioner came in this case in confessional statement of co-accused Sarvesh Kumar, who disclosed that he through the petitioner hired co-accused Mantu Singh and others for killing the deceased. Subsequently, coaccused Mantu Singh committed the murder of the deceased. The aforesaid Sarvesh Kumar also disclosed that he had transferred Rs.1,00,000/- in the account of the petitioner from the account of his mother. Subsequently, petitioner was arrested and confessed
Patna High Court Cr.Misc. No.28497 of 2016 (4) dt.03-10-2016 2/2 his guilt leading to recovery of one pistol and cartridges from his house which are said to have been used in committing the crime. Submission on behalf of the petitioner is that there is nothing on the entire case diary to show that the seized pistol and cartridges had been used in the present crime and, as a matter of fact, the petitioner had business transaction with co-accused Sarvesh Kumar. It is further submitted that moreover, co-accused Sarvesh Kumar and Bhola Das have already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that investigation against the petitioner has already been completed, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Madanpur P.S. Case No.112 of 2015.
