The petitioner is apprehending his arrest in connection with Bidupur P.S.Case No.87/19 registered for offences punishable under Sections 25(1-b)/26/35 of the Arms Act.. Prosecution story is that the police intercepted the Hyundai Car and found three persons sitting in the suspicious condition, the police inquired about the same, on which one person succeeded in fleeing away and two persons have been arrested and from their surrender one cartridge of 9 mm and other articles were recovered, they have disclosed the name of the petitioner as the third persons, who succeeded din fleeing away.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.51588 of 2019(2) dt.19-08-2019 2/2 that he has no criminal antecedent. He has falsely been implicated in this case Heard learned A.P.P. ,w ho has opposed the prayer for bail..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid direction, this application is dismissed.
