SMT PUSHPA SINHA, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 272 & 273 of the Indian Penal Code and Section 30 (A) of Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 228 liters of Nepali Saufi wine were recovered from the Bhusa Ghar of the petitioners which is about 3 K.M. away from the petitioners' house and without any window and door. It is urged that the petitioners are in custody since 14.5.2017. It is claimed that their antecedents are clean.
Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on
Patna High Court Cr.Misc. No.33630 of 2017() dt.20-07-2017 2/2 furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of ADJ II cum Spl. Judge, Excise Act, Sitamarhi in connection with Bairgania P.S. Case No.117 of 2017.
If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
