JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-09-2016 Interlocutory Application No. 4964 of 2014 has been filed for condoning the delay in filing this miscellaneous appeal which has been filed after delay of 8 months and 9 days.

Heard learned counsel for the appellant and learned counsel for respondents no. 1 and 2.

The ground taken in the limitation petition appears not probable and reasonable. The delay occurred in filing appears not fit to be condoned.

Under the circumstances, I. A. No. 4964 of 2015 stands rejected. In the result, this miscellaneous appeal also stood dismissed being time barred.

The statutory amount, i.e. Rs. 25,000/- deposited, be sent back to the learned Tribunal for paying the same to the claimants adjusting the same in the amount of award.
