This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the First Information Report of Shankarpur P.S. Case No. 90 of 2013 instituted for the offence under Sections 420, 468, 471 and 120B of the Indian Penal Code.

Report was called for from the court below which has been received. The court below has mentioned in the report that police has submitted charge sheet against the petitioner along with other accused persons and cognizance has already been taken against this petitioner. The case is pending in the court below for appearance of the petitioner and other accused persons.

Therefore, this Court does not find any reason to

Patna High Court Cr.Misc. No.26391 of 2015 dt.23-04-2018 2/2 interfere in the First Information Report lodged by the informant against the petitioner. The charge sheet has already been submitted and cognizance has also been taken against the petitioner. 4.

This Criminal Miscellaneous application is accordingly dismissed.

Petitioner is given liberty to raise all the points as raised in the petition either at the time of framing of charge or at appropriate state of trial.
