The petitioner seeks regular bail in connection with Baniyapur PS case no. 33 of 2016 registered for the offences punishable under Sections 341, 307, 120(B), 387/34 of Indian Penal Code and Section 27 of Arms Act.

The allegation leveled against the petitioner is regarding giving order to the co-accused to kill the informant. It is further alleged that the said co-accused Jitendra Sah is said to have fired upon the informant resulting firearm injury to the informant. The cause of incident is said to be the non-payment of extortion money.

No.30673 of 2017 (2) dt.07-07-2017 2/2 Learned Senior counsel for the petitioner submits that the petitioner has been enlarged on bail in all the cases mentioned in para 3 of the bail petition. It is further submitted that the person who had shot the informant has already been granted bail by this Hon'ble Court vide order dated 15.07.2016 passed in Cr.Misc. no. 21435 of 2016. It is next submitted that petitioner is in custody since 14.02.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Yadav, A.C.J.M. Saran at Chapra in connection with Baniyapur PS case no. 33 of 2016. It is further directed that the petitioner will make his attendance before the concerned P.S. on every Monday of each week at 10 am. In case, it comes to light that the petitioner has not been granted bail in any of the case mentioned in para 3 of the petition, the aforesaid privilege of bail would stand cancelled automatically.
